Overview

Douglas F. Darbut is a partner in Holland & Knight's Miami office. Mr. Darbut practices in the areas of institutional, municipal and consumer finance. He has more than 20 years experience in these areas. In the field of municipal finance, he has developed substantial experience representing providers of credit enhancement and indenture trustees. The bond issues have involved various types of credit enhancement such as letters of credit, bond insurance and standby bond purchase agreements, and include both fixed rate and variable rate transactions, as well as transactions involving reserve fund security policies, interest rate swap agreements, forward purchase agreements and inverse rate features. Specific transactions include revenue bonds, airport bonds, healthcare bonds, housing bonds, community development district bonds, other special district bonds, REMIC transactions and financings involving the pooling of assets. The transactions include not only new money and refunding issues, but also the restructuring of defaulted bonds, both in and outside of a Chapter 11 proceeding.

In the area of institutional finance, Mr. Darbut routinely represents the various types of institutions now providing the sources for such financing. These include banks, insurance companies and credit companies. He concentrates in asset-based and balance sheet financings, both at their inception, renewal and restructuring.

In the area of consumer finance, he provides counseling to a variety of banks, mortgage lenders and credit companies regarding the Florida Consumer Protection Laws, Mortgage Brokerage Act and the federal truth-in-lending laws.
