Substance Use Disorder Confidentiality Regulations Modified to Align with HIPAA

Pratt's Privacy & Cybersecurity Law Report
Beth Neal Pitman | Eddie Williams III

Healthcare & Life Sciences attorneys Beth Pitman and Eddie Williams co-authored an article in Pratt's Privacy & Cybersecurity Law Report summarizing notable changes to the Confidentiality of Substance Use Disorder (SUD) Patient Records regulations (also known as Part 2 of the "Part 2 Regulations"). As the attorneys explain, the U.S. Department of Health and Human Services' (HHS) Office for Civil Rights (OCR) and the Substance Abuse and Mental Health Services Administration (SAMHSA) developed the rules to better align with Health Insurance Portability and Accountability Act (HIPAA) and Health Information Technology for Economic and Clinical Health (HITECH) Act criteria and requirements.

The attorneys previously published a Holland & Knight client alert on this topic.
