Television Network Exonerated in False Light Invasion of Privacy Case

Holland & Knight helped a major television network win summary judgment, which was affirmed by the Maryland appellate courts, in a very difficult false light invasion of privacy case. The matter arose when a local affiliate station erroneously used file footage containing a truck bearing the logo of plaintiff's towing company to illustrate a story on the FBI arrests of a group of towing operators. The courts agreed that the plaintiff was required to show actual malice under the First Amendment and that the station's error did not rise to that level.
