Government Contracts: Alert - November 12, 2009

On November 30, 2009, the Supreme Court will hear oral argument in Graham County Soil & Water Conservation District v. United States ex rel. Wilson, a qui tam action brought under the False Claims Act (FCA) and appealed from a Fourth Circuit decision. The Court will use the case to resolve a split among the circuits over the scope of the FCA's "public disclosure" bar. A decision affirming the Fourth Circuit could increase qui tam litigation against any organization that does business with, or receives federal money through, federal, state and local governmental entities – and would further expand the reach of the FCA to any state or local program involving the use of federal funds.

Randall A. Pollard Joins Holland & Knight LLP

We are pleased to welcome Randall A. Pollard as a new governmental consultant with Holland & Knight LLP.  Randy joined us on May 16, 2000, and will be based in Holland & Knight’s Tampa office.

Randy recently retired from the Bureau of Alcohol, Tobacco and Firearms on January 1, 2000, after nearly 33 years’ service.  During his tenure with ATF, Randy worked and traveled throughout the country to handle numerous alcohol and tobacco regulatory matters.  ATF utilized Randy on numerous occasions as an instructor at the Federal Law Enforcement Training Center.  Randy’s final assignment was Area Supervisor, Tampa, where he supervised the every-day regulatory activities throughout Florida.

Randy was an Accounting major at Mississippi State University.  He and his wife Sandy live in St. Petersburg.
