Compliance Services: Alert - January 2, 2009

On November 12, 2008, the FAR Councils issued a final rule that further amends the FAR (Federal Acquisition Regulation) to amplify existing compliance program provi­sions (Subpart 3.10) and clauses (52.203-13 and 52.203-14). The rule also added requirements that contrac­tors and subcontractors disclose certain viola­tions of criminal law, violations of the civil False Claims Act, and significant overpayments.1 The new rule took effect on December 12, 2008. This new rule builds upon earlier compliance program requirements established in a December 2007 amendment to the FAR.

House Judiciary Committee Announces Retention of Holland & Knight's Alan Baron to Lead Inquiry into Possible Impeachment of Judge G. Thomas Porteous

WASHINGTON, D.C. – Alan I. Baron, co-chair of Holland & Knight's Congressional Investigations Team, was named by House Judiciary Committee Chairman John Conyers, Jr., to serve as Special Counsel in the impeachment inquiry into the conduct of U.S. District Court Judge G. Thomas Porteous.

The Bureau of Alcohol, Tobacco and Firearms (ATF) recently announced the appointment of three Program Managers assigned to the Market Compliance Branch. The individuals named are field personnel directly responsible for compliance program investigations, industry liaison and other program issues. Some of the areas of responsibility include trade practices, Internet sales, direct shipments, alcohol health matters, sampling, product tampering and permit concerns. The personnel appointed to these positions are career ATF employees recognized as experts in their program areas.
