Construction: Alert - October 13, 2008

In a recent decision with broad implications for the construction industry, the Massachusetts Appeals Court has held that general contractors owe a duty to their subcontractors' employees to provide a discrimination-free work environment. Because of the O'Connor decision, general contractors may now face discrimination lawsuits not only from their own employees, but also from employees of other companies at the job site. Discrimination lawsuits brought by non-employees are often outside the protections of commercial insurance policies. Are you covered?

Holland & Knight is pleased to announce that Jennifer Hernandez and Elizabeth “Betsy” Lake have joined the firm as Partners resident in Holland & Knight’s San Francisco office.

Ranked among California’s top 10 environmental lawyers by Chambers USA – America’s Leading Business Lawyers, Ms. Hernandez has achieved national prominence in work on brownfields redevelopment, wetlands and endangered species, and complex development projects. She represents clients in the private, public and non-profit sectors in land use and environmental project permitting, compliance, litigation and public advocacy work, and teaches land use and environmental law at Stanford Law School and the University of California.

Ms. Lake’s practice focuses on natural resources and environmental transactions, complex project permitting, compliance counseling and regulatory and legislative development. She also advises clients in land use, environmental review, permitting and litigation matters for complex land use and development projects involving environmental impact reports/statements, local entitlements, wetlands and endangered species issues. Ms. Lake brings significant experience in the enactment and amendment of environmental and land use statutes and regulations as well as environmental management, audit and enforcement matters involving federal, state and local agency regulation of air and water quality, hazardous materials and waste management, radioactive and medical product and material management, worker safety, wetlands, protected species and land use.

Ms. Hernandez and Ms. Lake are being joined by five associates and one senior counsel, who will work in San Francisco, and one of counsel and one associate, who will work in Holland & Knight’s Los Angeles office:
