OCR Guidance Explaining Significant Aspects of the Privacy Rule Released

January 31, 2003

On December 4, 2002, the Office of Civil Rights released a guidance that explains and answers questions about key elements of the requirements of the HIPAA Standards for Privacy of Individually Identifiable Health Information (the Privacy Rule).  The Department of Health and Human Services (HHS) published the Privacy Rule on December 28, 2000, and adopted modifications of the Rule on August 14, 2002. The Privacy Rule (45 CFR Part 160 and Subparts A and E of Part 164) provides the first comprehensive federal protection for the privacy of health information. The Privacy Rule, as modified, balances strong privacy protecting patient-access to their medical records, and continuing health care delivery.
