Compliance Services: Alert - January 2, 2009

On November 12, 2008, the FAR Councils issued a final rule that further amends the FAR (Federal Acquisition Regulation) to amplify existing compliance program provi­sions (Subpart 3.10) and clauses (52.203-13 and 52.203-14). The rule also added requirements that contrac­tors and subcontractors disclose certain viola­tions of criminal law, violations of the civil False Claims Act, and significant overpayments.1 The new rule took effect on December 12, 2008. This new rule builds upon earlier compliance program requirements established in a December 2007 amendment to the FAR.

Prominent Group of Private Wealth Attorneys Rejoins Holland & Knight

The U.S. Department of Agriculture is inviting proposals for the following programs:

FY 2002 Emerging Markets Program: $10 million dollars is available under this program to fund technical assistance activities that assist U.S. agricultural, agribusiness, or state departments of agriculture to improve market access and to develop and promote U.S. agricultural products and/or processes in low to middle income countries that offer promise of emerging market opportunities. Funding decisions will be announced in mid-July 2002.

FY 2003 Foreign Market Development Cooperator Program: This program reimburses nonprofit U.S. trade organizations for the shared costs of creating, expanding and maintaining foreign markets for U.S. agricultural commodities and products.

FY 2002 Market Access Program: $90 million dollars is available under this program to reimburse U.S. nonprofit or small-sized agriculture and agribusiness entities for the shared costs of certain overseas marketing and promotion activities.

FY 2002 Quality Samples Program: $2.5 million dollars is available under this program to reimburse U.S. agriculture and agribusiness entities for the shared costs of providing commodity samples to potential foreign importers.

Foreign Currency Program: The Foreign Agricultural Service is inviting proposals from parties interested in receiving funding from the USDA to support agricultural market development and technical assistance activities in Dominican Republic, Jamaica, Sri Lanka and Tunisia. As a result of agreements with the governments of these countries that permit repayment to the U.S. in local currencies, the U.S. Government currently holds 28 million Dominican Republic pesos, $210 million Jamaican, 12 million Tunisia dinars, and 1.7 million Sri Lanka rupees. The money will be disbursed in local currency to program participants, who are responsible to arrange for receiving and using the currencies or for converting the funds to other currencies.
