Government Contracts: Alert - January 2, 2009

On November 12, 2008, the FAR Councils issued a final rule that further amends the FAR (Federal Acquisition Regulation) to amplify existing compliance program provi­sions (Subpart 3.10) and clauses (52.203-13 and 52.203-14). The rule also added requirements that contrac­tors and subcontractors disclose certain viola­tions of criminal law, violations of the civil False Claims Act, and significant overpayments.1 The new rule took effect on December 12, 2008. This new rule builds upon earlier compliance program requirements established in a December 2007 amendment to the FAR.

Travel Restrictions Imposed on Zimbabwe; Extended for Iraq and Cuba

  • Zimbabwe: By Executive Order, the Bush Administration has suspended entry into the United States, on immigrant or non-immigrant visas, of senior members of the Mugabe government, their spouses and business associates. This order does not impose economic sanctions on business dealings with Zimbabwe. Click here for a copy of the order.
  • Iraq: The Department of State has extended the ban on travel by U.S. citizens to Iraq. U.S. passports remain invalid for travel to Iraq, unless specifically validated for such travel by the Secretary of State. Long-term residents of Iraq and professional journalists are exempted from this ban, which is now scheduled to expire in February 2003.
  • Cuba: The Bush Administration has again extended the national emergency with respect to Cuba and the limitations on the anchorage and movement of vessels in Cuba.
