Holland & Knight's National Media and Communications Team Achieves Significant Victory in Groundbreaking Defamation Lawsuit

WASHINGTON, D.C. – Holland & Knight's national Media and Communications team celebrated a significant victory recently in the California Court of Appeal, which vacated a trial court order compelling the deposition of a journalist being sued for libel. The ruling clears the way for the dismissal of the underlying libel lawsuit and the recovery of defense fees.

  • BXA Amendments on HPCs: BXA has issued a final rule amending the Export Administration Regulations (EAR) to implement the President’s decision to revise U.S. export controls on high-performance computers (HPCs). All HPCs continue to be eligible for export to a Computer Tier 1 country under License Exception CTP. Beginning March 3, 2002, HPCs controlled by Export Control Classification Number (ECCN) 4A003 with a CTP up to 190,000 millions of theoretical operations per second (MTOPS) can be exported to Computer Tier 3 countries under License Exception CTP without advance notification. This revision also applies to electronic assemblies and specially designed components controlled by ECCN 4A003. This rule also moves Latvia from Computer Tier 3 to Computer Tier 1, effective May 2, 2002. Finally, this rule adds Australia, New Zealand, Norway, Switzerland and Turkey to the list of countries eligible for exports and reexports of software and technology for computers with unlimited CTP under License Exception TSR.   • BXA Implements Wassenaar Arrangement: BXA has issued a final rule revising the Commerce Control List (CCL) to implement the changes in the export of Category 4 (computers) agreed to at the December 1, 2000, meeting of the Wassenaar Arrangement on Export Controls for Conventional Arms and Dual-Use Goods (the Wassenaar Arrangement). The Wassenaar Arrangement controls strategic items with the objective of improving regional and international security and stability. The changes are being implemented to reflect rapid technological advances and effective control factors. Additional changes in other categories agreed to by the Wassenaar Arrangement will be implemented in a supplemental regulation. In addition, this rule makes conforming and clarification revisions to License Exception CTP.   • Revisions and Clarifications to the Export Administration Regulations: Czech Republic, Hungary and Poland. BXA has issued a final rule amending the EAR to remove the license requirements for certain controlled items destined to the Czech Republic, Hungary and Poland to correctly reflect the status of those countries as NATO members. The items affected are: (1) military-related items, such as military vehicles and specially designed commodities used in the manufacture of military equipment, which are controlled for regional stability concerns; and (2) crime control and detection instruments and equipment, and related technology and software, which are controlled for human rights concerns. The rule is effective March 18, 2002.   • The Simplified Network Application Process (SNAP) began operating in mid-February 2002. SNAP 2002 is expected to be accessible industrywide in April/May 2002. Additional news and information will be distributed as it becomes available. SNAP is available at no cost to exporters to submit export and reexport applications, high-performance computer notices and commodity classification requests via the Internet in a secure environment; receive same-day acknowledgment of submissions; and obtain online validations (e.g., electronic facsimile of export license) from BXA. SNAP is used for the submission of license applications, commodity classification requests and high-performance computer notices. Current SNAP users are automatically registered to use SNAP 2002.
