Compliance Services: Alert - January 2, 2009

On November 12, 2008, the FAR Councils issued a final rule that further amends the FAR (Federal Acquisition Regulation) to amplify existing compliance program provi­sions (Subpart 3.10) and clauses (52.203-13 and 52.203-14). The rule also added requirements that contrac­tors and subcontractors disclose certain viola­tions of criminal law, violations of the civil False Claims Act, and significant overpayments.1 The new rule took effect on December 12, 2008. This new rule builds upon earlier compliance program requirements established in a December 2007 amendment to the FAR.

Department of Commerce Market Development Cooperator Program

The Commerce Department will now permit non-profit local development agencies, small business development centers, and trade associations to apply for Market Development Cooperator Program (MDCP) awards. MDCP is a competitive matching grant program designed to help small and medium- sized businesses promote U.S. products abroad. Awards are limited to $400,000 each, which may last up to three years. Award winners are required to match federal funds two to one. In addition to receiving funds, recipients also receive professional support from Department of Commerce trade experts, including customized briefings on markets and industries, assistance in organizing trade missions, facilitating private meetings with prescreened contacts in other countries, and organizing debriefings to determine appropriate follow-up strategies.
