On December 16, 2008, the U.S. Fish and Wildlife Ser­vice and the National Marine Fisheries Service published a final rule (Section 7 Rule) in the Federal Reg­ister that makes significant changes to certain provisions of the consultation requirements under Sec­tion 7 of the Federal Endangered Species Act (ESA). In one of the final actions of the Bush Administration’s environmental agenda, these actions set the stage for the Obama Administra­tion to wrestle with the scope of the ESA, and in particular, the interplay of climate change and its impact on endangered species.

USITC ATPA – Public Comment Request

The U.S. International Trade Commission(USITC) has called for comments regarding the Andean Trade Preferences Act (ATPA). Under Section 206 of the ATPA, the USITC is required to submit to the U.S. Congress an annual report concerning the ATPA’s economic impact on U.S. industries and consumers. The report also must address the efficacy of the program’s promotion of drug-related crop eradication and crop substitution efforts of the beneficiary countries. Each annual report must include the following analyses, as governed by section 206(b) of the Act:

  • the effect of ATPA on the U.S. economy generally as well as on specific domestic industries that produce articles that are similar to or directly competitive with articles being imported under the Act
  • the probable future effect that ATPA will have on the U.S. economy generally and on domestic industries affected by the Act and
  • the estimated effect that ATPA has had on drug-related crop eradication and crop substitution efforts of beneficiary countries

The USITC does not currently plan to hold a public hearing for its preparation of this report, but does invite the public to submit written comments regarding the issues listed above. Written comments should be received by the USITC on or before June 13, 2003, and should be addressed to the Secretary, United States International Trade Commission, 500 E Street S.W., Washington, D.C. 20436. Public submissions will be made available in the Office of the Secretary for those interested in reviewing submitted comments.
