Compliance Services: Alert - January 2, 2009

On November 12, 2008, the FAR Councils issued a final rule that further amends the FAR (Federal Acquisition Regulation) to amplify existing compliance program provi­sions (Subpart 3.10) and clauses (52.203-13 and 52.203-14). The rule also added requirements that contrac­tors and subcontractors disclose certain viola­tions of criminal law, violations of the civil False Claims Act, and significant overpayments.1 The new rule took effect on December 12, 2008. This new rule builds upon earlier compliance program requirements established in a December 2007 amendment to the FAR.

Upcoming Speaking Events

Janis Schiff and James Mayer will be speaking at the ICSC U.S. Shopping Center Law Conference on October 23-24 in Hollywood, Florida. Janis will participate on the panel, “Client Conflict Waivers: Considerations for Ethics, Liability and Client Relations.” Jim will serve on the panel, “Let Us Feed You: Issues in Restaurant Development & Leasing.” Janis serves as section leader and Jim is the deputy section leader for Holland & Knight’s Real Estate practice.

Holland & Knight will host a breakfast briefing, “Major Revisions to Washington, D.C.’s Zoning Regulations and 2008 Changes to the D.C. Construction Codes” on October 3 in Washington, D.C. The briefing will be moderated by Whayne Quin and address how the first comprehensive change to the zoning regulations since 1958 will impact existing and proposed development.

Mel Weinberger will be a panelist at the “Legal Structures and Regulatory Environment” workshop at the Vacation Ownership Investment Conference on October 7 in Orlando, Florida.

Ken Kecskes will serve on a panel entitled “San Francisco Bay Area Green Update” on October 15 in San Francisco,
California. He will discuss local and state mandates accelerating the green effort. Ken is the co-chair of Holland & Knight’s Residential and Master Planned Communities Practice Team. The conference is sponsored by Real Estate Media.

Chad Tiedemann, Shannon Sentman and Scott Sterling will serve on a panel at the Marsh/Holland & Knight Real Estate Forum on November 5 in Washington, D.C . The topics for discussion include the current insurance market, mixed-use projects including transit-oriented development, sustainable design and green building, and distressed real estate acquisitions.


Recent Speaking Events

James Norman
served on a panel, “Formula for a Successful Hotel/Resort Joint Venture,” at the Lodging Conference on September 23 in Phoenix, Arizona. The panel described the different types of joint ventures and discussed the business and legal elements necessary to structure a joint venture in the current difficult economic environment. Jim is the co-chair of the Global Hospitality, Resort and Timeshare Team.

Steve Elrod
recently co-chaired the 2nd Annual Land Use Law Conference: Development and Zoning in the City of Chicago and the Chicago Suburbs. Steve is the chair of the National Land Use and Government Practice Team. Also, Victor Filippini and Debborah Haddad were among the land use and zoning lawyers, planners and government officials that spoke during the two-day conference. The event was sponsored by CLE International.

Janis Schiff recently spoke at the Fall Real Estate Conference on September 18 in Washington, D.C. Janis serves as section leader for Holland & Knight’s Real Estate practice. The event was sponsored by Bisnow.

Holland & Knight recently hosted “Life in a Down Market: Real Estate and Land Use Issues in a Challenging Economy” in its Tampa, Florida office. The seminar featured perspectives from James Shimberg, David Singleton, Homer Duvall and
