For almost 50 years, lessors have had the ability to limit their liability for liens that arose from improvements to the leasehold made by a lessee. However, in the most recent legislative session, the Florida Legislature enacted revisions to Florida Statute ยง 713.10 that provide a potential pitfall for lessors by inserting a provision that may allow a contractor to lien the lessor's interest even where there is a recorded document advising of the limitation of liens.

Contestant: “What is the National Transportation Safety Board’s 2008 Annual Report To Congress?”

As suggested by that correct answer in the fictionalized game show question-and-answer, we close this issue of Centerline with a brief discussion of the NTSB’s 2008 Annual Report to Congress, which was released on July 1, 2009.1 The report provides an overview of the NTSB’s work in 2008, including details of ongoing and completed investigations; it also discusses key achievements regarding the “Most Wanted List of Transportation Safety Improvements.”

The 178-page, full-color report includes numerous photographs and maps, statistical charts and graphics. It also includes new sections discussing accomplishments in information technology, international outreach, and planning and performance.

The report covers a variety of aviation, highway, marine, railroad, pipeline and hazardous materials matters. Aviation highlights include seven major accident investigations, 206 regional accident investigations, 18 international accident investigations for which support was provided in accordance with international treaty, 13 major reports and accident briefs adopted, 86 safety recommendations issued, and various recommendations closed.

The press release issued by the NTSB in connection with the 2008 Report quotes remarks by NTSB Acting Chairman Mark V. Rosenker concerning, among other things, the “top ten” workplace ranking: “I am especially pleased that the Partnership for Public Service rated the NTSB as one of the top ten federal government workplaces in its 2009 rankings, as a clear indication of the satisfaction all of us here at the Board receive from the important work we do here every day.”2
