The article discusses the increasing application in U.S. federal courts of the 1910 Brussels Collision Convention which has not been ratified by the United States. In addition, it analyzes the recent Second Circuit decision affirming that when a court applies the 1910 Collision Convention there are no presumptions regarding causative fault for a collision, which would otherwise be applied under the U.S. substantive law known as The Pennsylvania Rule.
