New Regulations Require Government Contractors to Investigate and Self-Report Criminal Violations

New regulations were placed on December 12, 2008 that require government contractors and subcontractors to self-report violating federal criminal laws, including fraud, conflict of interest, bribery or gratuity. Apart from mandatory disclosure requirements, contract clauses have been set forth by the new rule. The clauses state that most contractors and their subcontractors must implement and maintain a full compliance program. Failure to fulfill these terms can result in contract termination. The article address these regulations, which are a part of the Federal Acquisition Regulation (FAR) that oversees contracts for the procurement of goods and services by the Department of Defense, the General Services Administration and the National Aeronautics and Space Administration.
