Brian Albritton, a partner in Holland & Knight's Tampa office, authored "Presumption of Guilt: Taking the Fifth in Civil Proceedings" which was published in the ABA's Litigation Magazine in Fall 2007 (v. 34, no. 1). The article assesses the issues involved with advising clients whether to plead the Fifth Amendment in non-criminal matters. Albritton also provides historical background on the legal question of self-incrimination and covers topics such as "taking five" in special situations like congressional proceedings.
