D&O Insurance Update

D&O and Management Liability Insurance Partner Stephen Weiss authored the article "Is the hard market softening?" published in the Summer 2004 issue of the D&O Insurance Update.

The article states the opinion that the market is beginning to soften for directors' and officers' (D&O) insurance. Through interviews with experienced brokers and his own recent work on nearly 50 D&O insurance cases, Mr. Weiss points to a trend of flat and decreasing premiums, higher policy limits and the willingness of insurers to negotiate coverage-enhancing endorsements; all key signs that the market has softened.

Mr. Weiss cites specific examples of changes in ideology within the past year to insurance companies' core issues. In light of these measures, Mr. Weiss suggests that companies negotiate the terms of their insurance and enter with the expectation that compared to just one year ago, premiums will be lower, coverage enhancements will be negotiable and higher policy limits will be available.
