TAMPA, Fla. – Holland & Knight has filed a copyright
infringement lawsuit in Federal District Court in Tampa today on behalf of
client Baby Boomer Headquarters against J Jargon Company, the Florida-based
production company of Menopause the Musical, the popular musical production that
has been seen worldwide by an audience of more than 40 million viewers to date.
The lawsuit brings an action against Menopause the Musical asserting that the
musical has copied the "Official Baby Boomer Qualifying Exam" in its programs,
which are distributed at all performances, without knowledge or permission from
the author, John Thornton. Thornton, the one-man personality behind Baby
Boomer's Headquarters, says, "We wrote the Official Baby Boomer Qualifying Exam
years ago. It’s a big success and I'm sure that Menopause the Musical fans
enjoyed reading and answering its questions. But the musical shouldn't have
reproduced it under a different name in the program without our permission. They
would not like anyone copying their play."
"The suit seeks potentially millions in damages if Menopause the Musical's
boast on their website of 40 million viewers is accurate," said Bill Hamilton,
the Holland & Knight partner handling the lawsuit for Thornton. "The suit asks
the musical's production company to honor and compensate the intellectual
property rights of our client. The production company, which has made millions
of dollars producing the musical around the world, must now face the music of
the Baby Boomer Headquarters'' copyright infringement lawsuit."
