Government Contracts: Alert - November 12, 2009

On November 30, 2009, the Supreme Court will hear oral argument in Graham County Soil & Water Conservation District v. United States ex rel. Wilson, a qui tam action brought under the False Claims Act (FCA) and appealed from a Fourth Circuit decision. The Court will use the case to resolve a split among the circuits over the scope of the FCA's "public disclosure" bar. A decision affirming the Fourth Circuit could increase qui tam litigation against any organization that does business with, or receives federal money through, federal, state and local governmental entities – and would further expand the reach of the FCA to any state or local program involving the use of federal funds.

Labor, Employment and Benefits: Alert - November 10, 2009

On October 28, 2009, President Obama signed into law a Defense Department Fiscal Year 2010 authorization bill that expands the Family and Medical Leave Act’s (FMLA) requirements with respect to “qualifying exigency leave” for family of military members and “military caregiver leave.” Specifically, qualifying exigency leave now applies to employees who have family members on active duty military service in a for­eign country, and military caregiver leave applies to family members of veterans, not just active duty service members. Although the law does not specify an effective date, it ap­pears to take effect immediately.

Holland & Knight Establishes Endowed Scholarship at Florida A&M University College of Law

ORLANDO, Fla. – Holland & Knight is pleased to announce that the law firm has recently established an endowed scholarship at Florida A&M University College of Law. The annual scholarship, the first of its kind at the law school, will provide the selected second-year law student with in-state tuition for one year as well as an offer of employment as a summer associate with the firm following the second year of law school.

"Holland & Knight is committed to supporting Florida's future lawyers and law schools such as Florida A&M University College of Law," said Bill Wilson, executive partner of the firm's Orlando office. "As a law firm with Florida roots and a strong Florida presence, we understand the importance for our state to provide talented law students with opportunities to receive a quality legal education."

"Holland & Knight is proud to establish this endowed scholarship at Florida A&M University College of Law," said Martha Barnett, former president of the American Bar Association and a partner in the firm's Tallahassee office. "Like our law firm, Florida A&M University is a leader with a longstanding tradition of providing opportunities for minority students."

"This scholarship demonstrates another step in Holland & Knight's partnering with Florida A&M University College of Law," said Albert Tellechea, a partner in the firm's Central Florida Litigation Group. "Our firm's involvement in FAMU's Moot Court Program and the recent creation of the Holland & Knight Lecture Series challenge students to develop the skills expected of leaders in the legal profession."

Each year, the scholarship Selection Committee at Florida A&M University College of Law will evaluate upcoming second-year students based on the following criteria: faculty evaluation and recommendations, academic credentials and community service involvement. The Committee will then recommend a worthy candidate to Holland & Knight's review board, comprised of representatives from the firm's Orlando-based Real Estate, Legislative and Business practice groups, which will make the final selection before the Fall semester.
