The U.S. Supreme Court recently denied an employer’s request for review of a decision by the U.S. Court of Appeals for the Eighth Circuit, which held that tipped employees spending more than 20 percent of their time performing related but non-tipped duties must be paid the full minimum wage for that time, without the tip credit.

Holland & Knight Partner William F. Hamilton Offered Remarks at Association of Certified Fraud Examiners Annual Seminar

TAMPA, Fla.William F. Hamilton, Holland & Knight partner in the firm's Tampa office, recently spoke at the Tampa Bay Chapter of the Association of Certified Fraud Examiners 10th Annual Fraud and Computer Crime Seminar, in Clearwater, Fla. on May 25-26, 2009. His topic entitled "Electronic Data: From Collection Through Authentication To Admissibility" covered electronic evidence in court proceedings in a presentation.

The presentation focused on best practices to assure that the data is allowed to tell its story. Hamilton also discussed hash techniques, encryption, certification, time stamping, and other techniques to employ at the collection phase which allow the data to become effective evidence at trial.

Hamilton is Board Certified in Business Litigation and Intellectual Property by The Florida Bar. His work includes complex business litigation in the areas of contract, software, and technology disputes, intellectual property (copyright, trademark, patent and trade secrets law), e-commerce, data security, telecommunications, trade regulation and unfair trade practices, and commercial real estate. He currently serves as co-chair of Holland & Knight's national E-Discovery practice and teaches Electronic Discovery and Digital Evidence as an Adjunct Professor at the University of Florida's Levin College of Law. He is also a featured speaker and writer on business litigation, electronic discovery and evidence.
