Business and Tax: Alert - August 27, 2008

In a significant, taxpayer-friendly pronouncement, the IRS ruled that a total return swap, the return of which is calculated by reference to a broadly based real estate index, does not give rise to a U.S. real property interest (USRPI) for purposes of Section 897. Rev. Rul. 2008-31 is noteworthy for non-U.S. persons investing synthetically in U.S. real estate related assets for at least two reasons which will be discussed, along with other issues, in this alert.

MIAMI – Maria Currier, a partner in Holland & Knight's Miami office, was named chair of the firm's national Health Law and Life Sciences Team, one of the largest health law and life sciences teams in the U.S.

"Maria's wealth of experience in the health care industry and her demonstrated leadership skills will benefit our clients in this important and growing practice area," said Jim McDermott, chair of Holland & Knight's Business Section.

Currier is a member of the firm's Business Section and has more than 20 years of experience serving clients in the health care industry. Her practice focuses on general corporate matters, mergers and acquisitions, joint ventures, commercial transactions, health care regulatory matters, fraud and abuse, managed care and international business ventures for health care clients. Currier has counseled clients on Medicare & Medicaid reimbursement and regulatory issues, HIPAA, federal and state fraud and abuse matters, Stark-related matters, corporate compliance plans, false claims act compliance and physician incentive arrangements.

Currier is Board Certified in Health Law as recognized by the Florida Bar. She has been recognized in health care law by The Best Lawyers in America and Chambers USA.
