Government Contracts: Alert - December 1, 2008

Beginning January 15, 2009, most federal contractors and subcontractors will be required to use E-Verify to verify the eligibility of their employees to work in the U.S. A recent final rule, which amends Federal Acquisition Regulations pursuant to a June 6, 2008 Executive Order, requires certain government contracts to contain a clause requiring contractors to enroll in and use E-Verify. Previously, participation in the program was optional. This alert provides a summary of the E-Verify program, its applicability to federal contractors and its requirements.

Buying employment practices liability insurance ("EPLI") requires navigating a maze of daunting complexity. Today, about 50 insurance companies offer EPLI policies, each using its own form. Even the simplest of these policies have an intimidating number of detailed definitions, exclusions and conditions, with nuances of wording that can have very costly consequences down the line. Narrow definitions and overly broad exclusions found in many EPLI policies can wind up leaving you exposed to a multimillion-dollar loss.

Fortunately for insureds, EPLI policy forms are not cast in concrete. Because EPLI premiums are substantial and the market highly competitive, nearly all insurance companies will invest time to consider amending their policies to meet your needs. Too few insureds avail themselves fully of this opportunity, and, as a result, many discover devastating coverage shortfalls after a claim has been made against them.
