The Due Diligence Process in Today's Economy: Meeting New Challenges

Inside the Minds: Business Due Diligence Strategies, 2010 Edition

June 1, 2010

Mergers and Acquisitions Partner Jeffrey Arouh authored a chapter titled, "The Due Diligence Process in Today's Economy: Meeting New Challenges" for the book series Inside the Minds in its recent publication, Business Due Diligence Strategies. The book is a compilation of essays on tailoring the due diligence process to fit the client's goals, avoiding common pitfalls, and understanding new techniques and trends.

The chapter authored by Mr. Arouh discusses the due diligence process in the context of a merger or acquisition transaction and how the process provides an opportunity for both the seller and the buyer to get a clear idea of the entity or business involved. He also explains how recently this process has changed due to the global economic crisis, the rise in a global economy and the development of a more litigious culture, presenting such challenges as the increased emphasis on the compliance element of the due diligence process and an inability to rely on past performance as a predictor of future performance.
