Union Relations Team Responds Quickly to Union Organizing Efforts
Members of Holland & Knight's Labor Relations for Management Team in Chicago successfully represented a company in its efforts to defeat a union organizing campaign. The Union had filed a petition with the National Labor Relations Board seeking to represent a unit of the company. Shortly thereafter, the Union filed an amended petition in which it sought to cherry-pick and represent a subset of drivers that represented only a fraction of the originally petitioned-for unit.
Our Labor Relations for Management Team worked closely with the company to develop an overall campaign strategy, train the company's management team on how to effectively respond to union organizing efforts, prepare the company's campaign materials, and counsel the company through the various twists and turns that inevitability arise during the course of a union election campaign. We quickly marshaled the evidence and arguments necessary to convince the assigned Board agent that the Union's position was incorrect. Desiring to avoid the cost and delay associated with a full-blown hearing, the Union agreed to an election in the larger unit.
The company's strategy and aggressive campaign paid off. In an NLRB-conducted election, the employees voted against Union representation by a 2-to-1 margin. Under applicable legal rules, the Union is barred from further efforts to organize the company's drivers for a period of one year.
