The Supreme Court Decision in Citizens United v. FEC

This alert reviews key aspects of last week's landmark Supreme Court decision in Citizens United v. FEC, in which the Court cleared the way for corporations and labor unions to contribute to political campaigns in a more direct way - and permitted those entities to pay for express advocacy as long as the advocacy is not coordinated with any campaign or political party. It also points to underreported aspects of the ruling, and areas of campaign finance rules that will remain the same.

While most of the popular press surrounding the Patient Protection and Affordable Care Act and the Health Care and Education Reconciliation Act has focused on patients, providers and payers, the law also significantly changes how life sciences companies will do business.

Spurred by the desire to reduce health care costs while increasing quality of care, Congress has increased the government's ability to promote the development of new products and test the effectiveness of old ones. The law creates a host of new opportunities for companies to advance their products, as well as new challenges they need to address.
