Business and Tax: Alert - August 27, 2008

In a significant, taxpayer-friendly pronouncement, the IRS ruled that a total return swap, the return of which is calculated by reference to a broadly based real estate index, does not give rise to a U.S. real property interest (USRPI) for purposes of Section 897. Rev. Rul. 2008-31 is noteworthy for non-U.S. persons investing synthetically in U.S. real estate related assets for at least two reasons which will be discussed, along with other issues, in this alert.

Holland & Knight Appoints Adolfo Jimenez as Firmwide On-Campus Recruiting Partner

MIAMI – Holland & Knight LLP today announced that Adolfo Jimenez, a partner in the firm’s Miami office, has been appointed firmwide On-Campus Recruiting Partner.  

In this important role, Jimenez will be responsible for the oversight of the firm’s Summer Associate program and on-campus interviewing process. He will also chair the firm’s On-Campus Recruiting Committee.

“Our Summer Associate program and on-campus interviewing are vital recruiting efforts that produce the large majority of Holland & Knight associates,” said Holland & Knight Managing Partner, Howell W. Melton, Jr. “Adolfo brings enthusiasm, energy and experience to this job, having served as Miami’s hiring partner and having been a Holland & Knight Summer Associate himself.”

Jimenez practices in the areas of international litigation, media law and transportation. Specific areas of experience include foreign law and foreign parties, complex civil lawsuits, arbitration, Spanish language media, newsroom issues, hotel operators, maritime matters and other transportation concerns including airlines, cruise lines, railroads and international shippers.
