Construction: Alert - January 30, 2012

For almost 50 years, lessors have had the ability to limit their liability for liens that arose from improvements to the leasehold made by a lessee. However, in the most recent legislative session, the Florida Legislature enacted revisions to Florida Statute § 713.10 that provide a potential pitfall for lessors by inserting a provision that may allow a contractor to lien the lessor's interest even where there is a recorded document advising of the limitation of liens.

Holland & Knight Announces New Leadership in Atlanta

ATLANTA – Alfred "Al" Adams has been appointed to serve as executive partner of Holland & Knight's Atlanta office. Adams, a litigation partner and member of the firm's national Directors Committee, will oversee the day-to-day management of the Atlanta office and focus on the expansion of its core practices, which include commercial real estate, business litigation, private wealth services, public law and corporate work. In addition, Litigation Partner Susan Housen has been named practice group leader for Holland & Knight's Litigation-Atlanta group. In her new role, she will provide strategic guidance in developing and expanding the firm's litigation practice in Georgia.

"Al is a highly respected litigator who brings proven leadership skills to his new role as executive partner," said Managing Partner Howell Melton. "Susan is a creative and skilled lawyer with extensive litigation experience. I am confident that the firm and our Atlanta office will benefit greatly from their tremendous talent and energy."

Adams will maintain his successful litigation practice, which includes more than 30 years of experience conducting jury and non-jury trials involving commercial law disputes, product liability cases and civil suits, including construction, environmental, joint venture/partnership, toxic tort, class actions, administrative, probate, premises liability and real estate litigation. He also has successfully resolved litigation through alternative dispute resolution in many forums. In addition to his leadership roles within the firm, Adams has held leadership roles in the community, including former board president of Sheltering Arms, a large Atlanta child care provider; board member of the Georgia Justice Project, Inc.; and a founder of the National Asbestos Council.

Housen practices litigation with an emphasis in securities litigation and regulatory matters, employment litigation, complex commercial litigation, and class actions. Her commercial and business practice includes the representation of banks and mortgage companies in contract disputes and litigation arising from the origination of fraudulent loans. Housen currently serves as a member of the City of Atlanta Board of Ethics.
