There has been considerable debate on Capitol Hill this year over the taxation of a Carried Interest in the context of a Private Equity Fund (PEF). At the same time, there has been public discussion of the role that the private equity industry will have in our economic recovery. In the realm of estate planning, PEF Principals possess unique opportunities to shift the performance of their interest in a PEF to future generations – potentially resulting in very significant estate tax savings. This article will review the basic PEF structure, describe the nature of a Principal’s interest in a PEF and indentify wealth transfer techniques that should be considered by a Principal.

Holland & Knight Partner Deborah E. Barnard Honored by the Women's Law Association at Boston University School of Law

BOSTON – Holland & Knight is pleased to announce that Boston partner Deborah E. Barnard was honored recently by the Women's Law Association at Boston University School of Law during the school's first ever Women-in-Law Conference, held March 24 - 27, 2008.

A 1987 alumna of Boston University School of Law, Barnard was recognized for her outstanding achievements as a female attorney. She spoke during the Women's Law Association's 13th Annual Meet the Women cocktail reception: A Tribute to BU Law Alumnae and Their Achievements.

Barnard, who concentrates her practice at Holland & Knight in complex civil litigation, has experience with both individual and class action lawsuits. Her practice encompasses a broad spectrum of substantive areas, with specific areas of focus on environmental cost recovery and property damage, toxic tort, products liability, and commercial disputes. Barnard has represented clients in both court actions and administrative proceedings before various regulatory agencies.

She also has significant experience with various forms of alternative dispute resolution and has successfully mediated several complex multi-party actions. Barnard has served as a faculty member for various continuing legal education courses sponsored by the Massachusetts and Boston Bar Associations.

Within Holland & Knight, Barnard holds several leadership positions. She serves on the firm's Directors Committee; as Litigation Deputy Section Leader for Professional Development and Recruiting; and as the Deputy Executive Partner in the Boston office. In addition, she is the co-coordinator of Holland & Knight's Rising Stars program, an intensive economic and leadership development training program for women attorneys in the firm, and has served as the national chair of the firm's Women's Initiative.

In her community, Barnard serves on the Women's Network Advisory Committee for the Boston Chamber of Commerce and participated in LeadBoston, a community leadership training program sponsored by the National Conference for Community and Justice.
