Intellectual Property and Technology: Alert - November 17, 2009

Governor Patrick’s Office of Consumer Af¬fairs and Business Regulation announced on November 4, 2009, that it has filed the final Massachusetts ID Theft Regulation, also known as 201 CMR 17:00. The goal of Regulation 201 is to help combat the loss of personal information; the most significant change is a require¬ment that covered entities amend existing agreements that they have with third-party service providers to include language requiring these providers to implement and main¬tain “appropriate” security measures for the protection of personal information.

Environment: Alert - November 18, 2009

Environmental justice – a mix of environmental and civil rights law and policy – is receiving in­creased attention in the Obama Administration, bringing with it challenges and opportunities for municipalities, facilities and others operating in low-income and minority communities. This alert discusses various aspects of environmental justice and the implications for the Obama Administration. Federal agencies, including the DOJ and EPA, have concluded that low-income and minority communities bear a greater environmental risk than the general population. Brad Newberg Joins Holland & Knight’s Northern Virginia Office as Senior Counsel in the Intellectual Property Group

McLean, Va – Holland & Knight is pleased to announce that Brad Newberg has joined the firm's Northern Virginia office as Senior Counsel in the Intellectual Property Practice Group.

Newberg concentrates his practice in intellectual property litigation, including copyright, trademark, trade secret, dilution, unfair competition, and other intellectual property matters. He has extensive knowledge in all aspects of litigation, including conducting direct examinations and cross-examinations at trial, arguing and drafting motions, supervising large-scale discovery, presenting at mediations, and taking and defending well over one hundred depositions.

Newberg has also has substantial experience in analyzing potential damages awards in trademark and copyright cases, bettering his ability to counsel clients as to the potential magnitude of recoveries or potential liability exposure.

Immediately prior to joining Holland & Knight, Newberg was a founding partner of Newberg & Winters LLP, an intellectual property focused firm, and an associate with Arnold & Porter LLP. Additionally, he served as a judicial clerk for the Honorable Louis L. Stanton of the United States District Court for the Southern District of New York.

Newberg holds a B.S.E from University of Pennsylvania’s Wharton School of Business, a B.A. in Economics from the University of Pennsylvania and graduated cum laude from the University of Pennsylvania Law School. He also served as Articles Editor of the University of Pennsylvania Law Review.
