For almost 50 years, lessors have had the ability to limit their liability for liens that arose from improvements to the leasehold made by a lessee. However, in the most recent legislative session, the Florida Legislature enacted revisions to Florida Statute § 713.10 that provide a potential pitfall for lessors by inserting a provision that may allow a contractor to lien the lessor's interest even where there is a recorded document advising of the limitation of liens.

Labor, Employment and Benefits: Alert - February 6, 2012

The U.S. Supreme Court recently denied an employer’s request for review of a decision by the U.S. Court of Appeals for the Eighth Circuit, which held that tipped employees spending more than 20 percent of their time performing related but non-tipped duties must be paid the full minimum wage for that time, without the tip credit.

Holland & Knight Partner David Black Elected Vice President of the Board of Contract Appeals Bar Association

MCLEAN, VA – Holland & Knight is pleased to announce that David Black, a partner in the firm's northern Virginia office, was recently elected as the Board of Contract Appeals Bar Association's (BCABA) Vice-President for 2009-10, which means he will serve as President of the BCABA for the 2010-11 program year. As Vice-President, he will be responsible for planning and executing the BCABA's Annual Program in October 2010.

David has been a member of the BCABA since 1998 and became an officer in 2008.

Black practices in the area of government contracts counseling and dispute resolution. His practice includes representing contractors in protests, claims under the Contract Disputes Act, responding to government investigations and audits, False Claims Act investigations and litigation, terminations for default and convenience, prime-subcontractor disputes, compliance programs, and counseling on a variety of contract administration and procurement issues.
