Construction: Alert - January 30, 2012

For almost 50 years, lessors have had the ability to limit their liability for liens that arose from improvements to the leasehold made by a lessee. However, in the most recent legislative session, the Florida Legislature enacted revisions to Florida Statute ยง 713.10 that provide a potential pitfall for lessors by inserting a provision that may allow a contractor to lien the lessor's interest even where there is a recorded document advising of the limitation of liens.

Managing Partner Steven Sonberg, Litigation Partner Peter Prieto, Alternative Dispute Resolution Partner William Sessions, Pro Bono Partners Buddy Schulz and Steve Hanlon and Litigation attorney Jordan A. Dresnick were featured in the Daily Business Review article "Holland & Knight Revamps Its Pro Bono Program" on October 20.

The article underscored Holland & Knight's effort to expand the involvement of its pro bono initiatives. Mr. Prieto indicated that the new program will help broaden the firm's reach to potential clients who otherwise may not have enough money to pay for their legal matters. "We have people that have lost their homes and have immigration issues, and there's a large number of folks that can't afford quality legal services," he added. "Those are the folks we want to help."

The new program will be headed by Mr. Schulz, Mr. Hanlon and Mr. Sessions. The changes come as part of Mr. Sonberg's initiative to enhance Holland & Knight's pro bono program. "We have been evaluating our pro bono and community service program since I assumed the role of managing partner in March of 2008 and concluded that, as good as it was, we could improve it by making a number of strategic and operational changes," Mr. Sonberg said.

Mr. Dresnick added that the program is "consistent with Holland & Knight's commitment to provide pro bono services to represent the less fortunate and ensure equal justice for all.
