Government Contracts: Alert - November 12, 2009

On November 30, 2009, the Supreme Court will hear oral argument in Graham County Soil & Water Conservation District v. United States ex rel. Wilson, a qui tam action brought under the False Claims Act (FCA) and appealed from a Fourth Circuit decision. The Court will use the case to resolve a split among the circuits over the scope of the FCA's "public disclosure" bar. A decision affirming the Fourth Circuit could increase qui tam litigation against any organization that does business with, or receives federal money through, federal, state and local governmental entities – and would further expand the reach of the FCA to any state or local program involving the use of federal funds.

Washington, D.C. – July 6, 2009 - Holland & Knight is pleased to announce Lisa Gilleland and Katherine O’Donniley, attorneys in the firm's Tampa office, have earned accreditation from the U.S. Green Building Council and are now Leadership in Energy and Environmental Design Accredited Professionals (LEED AP).

Gilleland and O’Donniley are now able to advise and assist Holland & Knight clients on the LEED certification process, which is designed to enable the implementation and achievement of the highest green building and environmental performance measures. They will be listed in the Green Building Certification Institute's LEED AP Directory under the "Legal" area of practice.

LEED APs have the professional knowledge and ability to help facilitate the LEED certification process for green and sustainable building. The LEED Green Building Rating System is the nationally accepted benchmark for the design, construction and operation of high-performance green buildings. LEED APs complete a rigorous certification process that includes a final exam.

Gilleland is an associate in Holland & Knight’s Tampa office and focuses her practice in commercial and residential real estate law, commercial leasing, acquisitions, secured lending, and condominium development and compliance. Gilleland earned a B.A. in Business Management and Economics from North Carolina State University and graduated cum laude with a J.D. from Georgia State University College of Law.

O’Donniley is an associate in the Real Estate Section in the Tampa office of Holland & Knight and focuses her practice within the firm's Land Use and Alcohol Beverage Practice Groups. She has represented clients before various local governmental bodies on issues relating to zoning, land use, local government comprehensive planning, code enforcement, and alcohol special use permitting. O’Donniley earned a B.A. in Literature and Anthropology from Florida State University and graduated cum laude with a J.D. from University of Florida College of Law.
