Government Contracts: Alert - November 12, 2009

On November 30, 2009, the Supreme Court will hear oral argument in Graham County Soil & Water Conservation District v. United States ex rel. Wilson, a qui tam action brought under the False Claims Act (FCA) and appealed from a Fourth Circuit decision. The Court will use the case to resolve a split among the circuits over the scope of the FCA's "public disclosure" bar. A decision affirming the Fourth Circuit could increase qui tam litigation against any organization that does business with, or receives federal money through, federal, state and local governmental entities – and would further expand the reach of the FCA to any state or local program involving the use of federal funds.

Labor, Employment and Benefits: Alert - November 10, 2009

On October 28, 2009, President Obama signed into law a Defense Department Fiscal Year 2010 authorization bill that expands the Family and Medical Leave Act’s (FMLA) requirements with respect to “qualifying exigency leave” for family of military members and “military caregiver leave.” Specifically, qualifying exigency leave now applies to employees who have family members on active duty military service in a for­eign country, and military caregiver leave applies to family members of veterans, not just active duty service members. Although the law does not specify an effective date, it ap­pears to take effect immediately.

Holland & Knight Partner Homer Duvall Installed as Chair of ABA's Title Insurance Litigation Committee

Tampa, Fla. – August 13, 2009 – Holland & Knight is pleased to announce that Homer Duvall, a partner in the firm's Tampa office, was recently installed as Chair of the Title Insurance Litigation Committee of the American Bar Association's (ABA) Tort Trial & Insurance Practice Section. Duvall's one-year term commenced August 1 during the ABA Annual Convention in Chicago.

ABA's Title Insurance Litigation Committee, which covers all matters relating to the law of title insurance, both legislative and judicial, has more than 225 members comprised of primarily attorneys who handle title insurance claims, either as in-house counsel for title insurers, coverage counsel retained to represent the insurer's interest, or counsel retained by the insurer to represent its insureds. The committee examines contractual and extra-contractual disputes between and among insureds, insurers, third parties and governmental or quasi-governmental bodies, as well as the application of real estate law to the resolution or prosecution of title insurance claims.

Duvall practices in the areas of real estate, both transactional and litigation, as well as title insurance defense and appellate representation. He has more than 40 years of experience working in and for the title insurance industry and with real estate problems, claims and recovery. In 2005, Duvall updated the title insurance chapter for Florida Real Property Title Examination and Insurance, published by The Florida Bar, which he has authored since 1996. Duvall received his B.S.B.A from the University of Missouri, and earned his J.D. from Stetson University College of Law.
