Labor, Employment and Benefits: Alert - November 10, 2009

On October 28, 2009, President Obama signed into law a Defense Department Fiscal Year 2010 authorization bill that expands the Family and Medical Leave Act’s (FMLA) requirements with respect to “qualifying exigency leave” for family of military members and “military caregiver leave.” Specifically, qualifying exigency leave now applies to employees who have family members on active duty military service in a for­eign country, and military caregiver leave applies to family members of veterans, not just active duty service members. Although the law does not specify an effective date, it ap­pears to take effect immediately.

Two Holland & Knight Attorneys Named 'Up and Comers' by Florida Trend Magazine

MIAMI – October 9, 2009 – Holland & Knight is pleased to announce that attorneys Jason Lazarus and Esther Moreno were named “Up and Coming” attorneys by Florida Trend magazine.

Florida Trend publishes a list of legal leaders each year. The magazine asks all practicing Florida Bar members to participate by naming the three “best up and coming attorneys” who exhibit leadership in the law and in their local communities. Winners are those who receive the most votes. An attorney must have practiced law for less than 10 years or be less than 40 years of age to be an eligible candidate.

Lazarus is a partner in Holland & Knight’s West Palm Beach office and practices in the firm's Litigation Department. His focus includes the representation of corporate and individual clients of the firm in wide ranging contractual and business disputes. Lazarus has experience handling partnership and shareholder disputes, real estate disputes, representation of financial institutions in areas of collection, foreclosure and creditors' rights, defending financial institutions and portfolio managers in connection with their investment management practices and representation of life insurance companies in coverage disputes.

Moreno is a partner in Holland & Knight's Miami office and practices in the firm’s Business Section. She advises public and private companies on corporate and securities law issues surrounding corporate finance transactions and mergers and acquisitions, including private and public securities offerings (IPO's, follow-on and secondary offerings, high-yield debt offerings, convertible notes offerings and Regulation S/offshore offerings), exchange/tender offers, asset and stock purchases, and other commercial transactions. Moreno has served as issuer's counsel in connection with over $4 billion in equity and debt offerings and debt tender offers by public companies in the past three years.
