Government Contracts: Alert - November 12, 2009

On November 30, 2009, the Supreme Court will hear oral argument in Graham County Soil & Water Conservation District v. United States ex rel. Wilson, a qui tam action brought under the False Claims Act (FCA) and appealed from a Fourth Circuit decision. The Court will use the case to resolve a split among the circuits over the scope of the FCA's "public disclosure" bar. A decision affirming the Fourth Circuit could increase qui tam litigation against any organization that does business with, or receives federal money through, federal, state and local governmental entities – and would further expand the reach of the FCA to any state or local program involving the use of federal funds.

Holland & Knight Attorney Rich Gold Appointed to The National Academy of Sciences Board on Environmental Studies and Toxicology

Richard "Rich" Gold- Washington

Washington, D.C. – November 3, 2009 – Holland & Knight is pleased to announce that attorney Rich Gold, leader of the firm’s Public Policy & Regulation (PP&R) Group in the firm's Washington, D.C., office, has been appointed to The National Academy of Sciences Board on Environmental Studies and Toxicology (Board).

The Board is a study unit for environmental pollution problems affecting human health, human impacts on the environment and the assessment and management of related risks to human health and the environment. Gold has worked with the Board informally over the last several years from a public policy perspective on several studies that they have undertaken, including a new study just commencing to develop a roadmap for environmental and health effects research on nanotechnology.

His new role on the Board is to bring a public policy view to complement the scientific issues under discussion. Board members represent a broad group of stakeholders on environmental and energy issues ranging from environmental groups to universities as well as private sector companies and trade associations. Gold will serve a four-year term and will be eligible to be re-nominated for a second four-year term.

Gold’s practice concentrates on legislative and environmental law, emphasizing strategy development, lobbying, legislative and regulatory counseling, and creative solutions to corporate, non-profit, and governmental issues at the federal level. He has lead Holland & Knight’s PP&R Group to become among the top 10 ranked law and lobby firms in Washington, D.C., by Influence magazine the last several years.

Gold joined Holland & Knight in 1994 after eight years of government service, culminating in stints with Senator Lloyd Bentsen and EPA Administrator Carol Browner. Gold's practice at Holland & Knight has focused on federal budget and appropriations funding and policy advocacy and legislative and regulatory counseling and consulting in a wide range of substantive fields from environment to food safety, transportation to energy efficiency and production.
