Construction: Alert - January 30, 2012

For almost 50 years, lessors have had the ability to limit their liability for liens that arose from improvements to the leasehold made by a lessee. However, in the most recent legislative session, the Florida Legislature enacted revisions to Florida Statute ยง 713.10 that provide a potential pitfall for lessors by inserting a provision that may allow a contractor to lien the lessor's interest even where there is a recorded document advising of the limitation of liens.

Chicago, IL – March 2, 2010 – Holland & Knight is pleased to announce that Christopher Carmichael and Colin Smith, attorneys in the firm's Chicago office, are authors of the Illinois chapter of Business Torts: A Fifty State Guide (2010 Edition). This is the fourth edition of the book and the fourth time Holland & Knight attorneys have authored the Illinois section.

The desk reference is a concise summary of the business tort laws of the 50 states as well as the District of Columbia. The reference is a guide for business litigation in more than one state and for policies covering business torts. It is designed to compliment two annual publications by Aspen: Product Liability Desk Reference and the Tort Law Desk Reference. Within the book is a summary of each state's common law and statutes with respect to business torts. Each summary is a designed as a starting point for litigation in a particular jurisdiction.

Carmichael is a partner with Holland & Knight and practices in the firm's litigation section. He concentrates his practice on resolving disputes between business and on appeals. He handles disputes for manufacturers of products, utilities, service providers, technology companies, banks, retailers, insurers and commercial property owners.
Smith is also a partner with Holland & Knight and practices in the firm's product liability, general tort and commercial litigation sections. Smith is also the co-editor of the Product Liability Desk Reference.
