Brett D. Carroll is a member of the Litigation Department and he concentrates his practice in state and federal court on title and real property disputes, products liability including drug and medical device litigation, medical malpractice claims, commercial contract disputes, and business torts including fraud, tortious interference, and noncompete violations. He has worked with owners, builders, and developers defending mold claims. Mr. Carroll is growing the firm’s abandoned property litigation practice, including acting as counsel in the first challenge to the Delaware escheat statute and practices as unconstitutional, defending clients pursuant to government initiated investigations, negotiating client's exposure with respect to business credits, analyzing foreign escheat issues and counseling clients concerning compliance issues in the rebate context. He represents clients in internal investigations, responding to and anticipating government inquiries by various government agencies. Mr. Carroll also counsels employers in a variety of employment matters focusing on workplace diversity and has defended companies in alleged class action matters involving issues of employment discrimination. Mr. Carroll has significant experience with all aspects of factual investigation and discovery including intensive electronic discovery disputes. He has managed large document productions including oversight of numerous third party vendors and contract attorneys, handled depositions of fact witnesses, named parties, and experts, argued substantive motions including motions for summary judgment, and prepared and tried cases for jury and non-jury trial. Mr. Carroll has argued before the Massachusetts Supreme Judicial Court and Appeals Court and has obtained three recent Appeals Courts decisions in his favor on real property matters. Mr. Carroll first joined Holland & Knight’s Fort Lauderdale, Florida office upon graduation from law school, and moved back home to the Boston office in 2003.
