Michael Prendergast leads the Labor and Employment Group in the firm's Jacksonville office. Mr. Prendergast represents private and public sector employers in employment litigation in state and federal court and before various administrative agencies. Mr. Prendergast also helps employers resolve employment issues by developing practical solutions that comply with the growing number of laws and regulations that impact the workplace. Mr. Prendergast's experience includes advice and litigation regarding the employment discrimination laws (Title VII, ADEA, ADA, Florida Civil Rights Act), National Labor Relations Act (including union avoidance, collective bargaining and arbitration), FMLA, FLSA, OSHA, reduction in force issues (including WARN notice requirements), non-compete, confidentiality and trade secret issues, public and private sector whistleblower laws, and work-related constitutional and common law claims. Mr. Prendergast has represented employers in several manufacturing, retail and service industries, including construction, transportation, shipyards, paper and paper products, automotive, healthcare, food distribution, grocery and beverage.
