Richard E. Lyon, Jr., a partner in the Los Angeles office, has been involved in representing clients in the fields of patent and trademark law and trade secret misappropriation and has extensive experience in licensing of intellectual property. With a background in mechanical engineering, he is actively involved in patent and trademark prosecution, as well as litigation. He represented Underwater Devices, Inc. in the landmark case against Morrison-Knudsen Company, Inc., 717 F.2d 1380 (Fed. Cir. 1983), establishing the standard of care necessary for relying on the advice of counsel to avoid a charge of willful patent infringement and upholding an award of treble damages. He argued the appeal before the Third Circuit in the trademark infringement case of Berner Int'l. Corp. v. Mars Sales Co., 987 F.2d 975 (3rd Cir. 1993) that is the leading appellate authority on genericness in the Third Circuit. He also successfully represented a leading Edison utility through numerous trademark disputes with other Edison companies following deregulation of the industry.
