A. Brian Albritton concentrates his criminal and civil practice in three related areas. He practices "white collar" criminal defense, and devotes a large portion of his practice prosecuting and defending claims relating to trade secret theft, noncompetition agreements and other restrictive covenants. Additionally, Mr. Albritton advises clients and handles litigation involving telemarketing, direct mail marketing, consumer and unfair and deceptive trade practice claims brought by the Federal Trade Commission and Attorneys General.

"White Collar" Criminal Defense.

Mr. Albritton has defended a variety of criminal defense matters in both state and federal courts, and handled numerous grand jury investigations, most on behalf of businesses. He has successfully defended significant matters involving claims of health care fraud (along with several qui tam cases), trade secret theft, environmental crimes, student loan fraud, bankruptcy fraud and tax fraud. In addition to his trial practice, clients frequently call upon Mr. Albritton to conduct internal investigations regarding alleged misconduct in their businesses (including issues involving Sarbanes-Oxley); defend and coordinate responses to subpoenas from investigative bodies; develop corporate compliance programs, conduct employee and management training on compliance issues; and advise witnesses. Comfortable in both civil and criminal litigation, Mr. Albritton frequently defends clients in the civil regulatory or other "parallel proceedings" which often arise in conjunction with a criminal investigation or indictment.

Trade Secrets, Noncompetition Agreements, and Other Restrictive Covenants.

Claims involving these areas are very similar to criminal practice: they frequently involve allegations of theft of trade secrets or other confidential business information by another business or competitor. Unlike traditional civil litigation, clients cannot afford to wait for discovery and trial; they must move expeditiously, often with little or no discovery, to prevent what may be irreparable harm due to the disclosure or loss of a key employee or trade secret. An outgrowth of his criminal practice, Mr. Albritton assembled a team that can quickly investigate and act to prosecute or defend claims involving trade secrets or restrictive covenants at the injunctive stage. Mr. Albritton also advises clients on how best to protect their confidential business information and trade secrets.

Telemarketing/Direct Mail/Unfair Trade Practices.

Mr. Albritton advises clients and handles litigation involving telemarketing, direct mail marketing, consumer and unfair and deceptive trade practice claims brought against companies by Attorneys General and the Federal Trade Commission. Mr. Albritton has a nationwide practice defending organizations involved in telemarketing and direct mail advertisements, including businesses in the hospitality, travel, credit counseling/debt management, and debt collection industries. He has successfully resolved unfair and deceptive trade practice cases brought by the FTC and Attorneys General in Florida and throughout the United States. In addition to litigation, Mr. Albritton advises clients how to comply with the myriad federal and state laws regulating telemarketing, direct mail and related types of consumer sales.

Along with these areas of concentration, Mr. Albritton has litigated a wide variety of complex commercial litigation matters throughout Florida. Court T.V., a national cable channel, televised Mr. Albritton's trial victory in State of Florida v. Wilson.

From 1988 to 1990, Mr. Albritton served as a law clerk to United States District Judge William Terrell Hodges of the Middle District of Florida. Mr. Albritton served as an adjunct professor of law at Stetson University College of Law from 1998 - 2004, where he taught both Federal Courts and Federal Criminal Law Seminar.
