Benjamin M. Stern is a senior counsel in the Litigation Section and a member of the firm's Intellectual Property Practice Group.
Mr. Stern’s practice focuses on intellectual property litigation and other complex disputes. He has litigated patent disputes involving a broad range of technologies, including semiconductors, database software, data storage systems, commercial Internet access, websites, voice over Internet (VoIP) technology, automatic speech recognition, video on demand and mineral fortification of beverages. Mr. Stern has appeared in numerous federal courts and at the International Trade Commission.
In addition to intellectual property, Mr. Stern has substantial experience in commercial litigation and other complex disputes in various industries such as banking, retailing, real estate, consumer products, manufacturing, pharmaceuticals and medical devices.
Mr. Stern’s practice covers all aspects of litigation, including pre-suit investigation, discovery, dispositive motions, settlement, alternative dispute resolution, trials and appeals.
Mr. Stern has made public service an important part of his practice. He has served as a special assistant district attorney in the Middlesex District Attorney’s Office, where he prosecuted cases involving violence, crime, financial fraud and other matters, including trying cases to judges and juries. He was appointed as a special assistant attorney general to represent the governor of Massachusetts in a successful effort to remove the chairman of the Massachusetts Turnpike Authority from office. Mr. Stern was named special counsel to the Massachusetts Board of Bar Examiners to investigate the character and fitness of bar applicants. He is also a town meeting member for the Town of Brookline.
Mr. Stern has a broad and active pro bono practice, including both federal district court and appellate litigation, with a particular focus on civil rights issues.
