David C. Borucke is a member of the firm's antitrust, trade regulation and competition practice group, functioning as both as a counselor and litigator. His antitrust experience includes conducting antitrust due diligence for mergers, acquisitions and joint ventures; assisting clients through the Hart-Scott-Rodino premerger notification process, including "second requests"; interfacing with regulatory authorities; reviewing proposed transactions for antitrust implications; creating antitrust compliance programs tailored to specific clients; and defending and prosecuting claims brought under the Sherman and Clayton Acts and equivalent state competition laws.
Mr. Borucke also has extensive appellate experience in diverse subject areas including admiralty, ad valorem taxation, antitrust, commercial disputes, eminent domain, ERISA, intellectual property, labor and employment, land use, personal injury, and trade secrets. Mr. Borucke has handled appeals in each of Florida's District Court of Appeals, the Florida Supreme Court, the Eleventh Circuit, and the United States Supreme Court. He is a member of the Florida Bar’s Appellate Practice Section, and was formerly a senior staff attorney with the Second District Court of Appeal.
Mr. Borucke also practices as a litigator and counselor in the firm's media law practice group. His areas of focus include defending defamation claims, protecting media access to government records and other news sources, and counseling clients with respect to advertising issues.
