Diane Rubin practices in the area of construction and real estate, including both litigation and transactional matters.

Ms. Rubin has extensive experience as counsel to both private and public clients in these areas. Her clients include general contractors and subcontractors, as well as awarding authorities and owners, most notably large condominium associations. As a lawyer who is well-versed in both litigation and transactional matters, Ms. Rubin is able to advise clients about how to avoid litigation, and when necessary, how to accomplish their goals in the litigation arena, whether in the courtroom or through mediation or arbitration.

Prior to joining Holland & Knight, Ms. Rubin served as Associate General Counsel for the Massachusetts Turnpike Authority where she was responsible for oversight of all litigation, which included several high profile eminent domain cases, lease, telecommunications, computer software and insurance disputes, in addition to construction and design negligence lawsuits. She participated in redrafting the General Terms and Conditions for the Authority's construction agreements and drafted many such agreements and bid documents. Her additional responsibilities included serving as counsel relative to the Authority's employment matters, such as discrimination and sexual harassment policies and complaints.

In private practice, both before and after serving at the Massachusetts Turnpike Authority, Ms. Rubin has had significant experience with real estate litigation, such as boundary disputes and environmental claims. She continues to advocate with governmental entities on behalf of private clients, in such matters as zoning and permitting and related land use issues. She assisted another public authority with developing a construction management program, including preparation of bid documents and agreements.
