Edward Diaz is in the firm's Litigation Section and primarily practices in the areas of Labor and Employment law. Mr. Diaz has successfully represented employers in non-compete cases and in litigation of employment discrimination claims before federal and state courts, the Equal Employment Opportunity Commission and the Florida Commission on Human Relations. Mr. Diaz provides counsel to employers on a wide range of issues, including management training, employment audits, drafting employment contracts, severance agreements, employment policies and handbooks, and non-competition agreements. In addition, Mr. Diaz advises clients on compliance with employment-related statutes and regulations.

Mr. Diaz has experience representing clients in a broad range of industries, including transportation, hospitality, health care, financial, higher education, professional and technology.

Representative Engagements

  • Obtained successful jury verdict in federal court for wholesale seafood supplier who was sued for alleged unpaid overtime.
  • Obtained defense judgment after jury trial in federal court on plaintiff's claim of discrimination and retaliation under the Americans with Disabilities Act.
  • Obtained summary judgment on multi-count complaint by two plaintiffs against national insurance company in action under Age Discrimination in Employment Act, and successfully obtained significant award of attorneys' fees and costs against plaintiffs.
  • Obtained summary judgment in federal court in race discrimination claim by plaintiff against one of the largest transportation/shipping companies globally, and successfully obtained significant award of attorneys' fees and costs against plaintiff.
  • Obtained injunctive relief against former employee of international marketing research company for theft of trade secrets and breach of non-compete agreement.

Within the firm, Mr. Diaz is the Hiring Partner and the Summer Associate Program Coordinator for the Miami office. Additionally, he is a member of the firm's Diversity Council, serves as the Chair of the Miami Local Office Diversity Committee, and is a member of the Fair Employment Practices Committee for the firm.
