Frederick D. Page practices in the litigation section of the firm, concentrating primarily in the areas of intellectual property, insurance coverage disputes and commercial litigation. Mr. Page is registered to practice before the United States Patent & Trademark Office and regularly counsels clients on protecting their rights under patent, copyright, trademark, unfair competition and trade secret laws. Mr. Page also regularly assists clients on a wide range of insurance coverage and other commercial disputes.

Intellectual Property Experience

  • Representing public and private companies on patent infringement matters
  • Defending and prosecuting trademark infringement and unfair competition actions on behalf of public and private clients to protect names, good will and branding investments
  • Enforcing product manufacturers' patent rights against infringers through litigation and licensing strategies
  • Protecting a leading agricultural supplier's market advantage provided by its process patent rights through patent infringement litigation
  • Protecting real estate developers with more than $70 million in capital investments in their housing projects against architects’ lawsuits for copyright infringement
  • Pursuing copyright infringement actions throughout Florida on behalf of members of one of the world’s largest performing rights licensing societies to protect those members' copyrighted musical compositions
  • Defending product manufacturers on claims of copyright infringement by competitors seeking to claim public domain materials as their own (including successful defense of 4 week jury trial in federal court resulting in order finding client entitled to an award of fees incurred defending the claims)
  • Prosecuting former employees, officers and shareholders of businesses of all sizes who leave and misuse confidential information to compete with their former employer
  • Advising public and private companies of all sizes on potential losses of customers and market advantages due to misappropriation of trade secrets and other proprietary information
  • Protecting the interests of public and private companies of all sizes in patent, trademark and software licensing disputes and licensing negotiations

Insurance Coverage Experience

  • Representing insurers and policyholders on numerous high value coverage disputes involving the following policy forms: Directors & Officers; Professional Liability, Malpractice and Errors & Omissions (including Technology Professional (E&O), and Media Professional (E&O)); Commercial General Liability (Bodily Injury claims, Property Damage claims, construction defect claims, business risk exclusion matters, Advertising Injury / Personal & Advertising Injury claims, and other intellectual property claims); Builder's Risk and Contractor's All-Risk; Business Auto, Commercial Auto and Garage Owners; Trucker's and Non-Trucking Insurance; Cargo and Contingent Cargo; Homeowners (Fire and Hurricane); Business Owners (Fire and Hurricane Property Damage and Business Interruption claims); Crime / Fidelity Bonds and Policies; Banker's Blanket Bonds / Financial Institution Bonds; Maritime Insurance (property claims); Railroad Protective Liability Insurance; and Employer Liability Policies;
  • Successful handling of lawsuits and disputes for workers' compensation carriers, health insurers and other primary insurers against treaty reinsurers, specific excess and stop loss excess carriers;
  • Successful handling of D&O coverage litigation for insurer, including appeal to the Eleventh Circuit Court of Appeals involving applicability of prior and pending litigation exclusion;
  • Representing insurers and policyholders on disputes involving duties to defend, reservations of rights, shared funding arrangements and claims administration statutes;
  • Defending primary carriers, self-insureds and TPA's on disputes with excess carriers regarding claims handling practices; and
  • Handling litigation for insureds and carriers involving the reasonableness and enforceability of consent judgments in Florida

Additional Commercial Litigation Experience

  • Representing health plans in disputes with non-participating health care providers involving reimbursement issues
  • Obtaining relief (damages and injunctions) for companies in disputes with former agents involving violations of restrictive covenants, fiduciary duties and related obligations
  • Handling contractual indemnity disputes and other contract based disputes
  • Representing national manufactures on jurisdictional issues throughout the U.S.
  • Assisting parties on disputes involving covenants not to compete
  • Representing a family of nursing homes in multimillion dollar litigation with its management companies
