Harold W. Potter, Jr. is a member of the Alternative Dispute Resolution Team in the Business Department. He concentrates his practice in civil litigation with particular emphasis on education law, fiduciary litigation, alternative dispute resolution, loss prevention issues, and business/commercial litigation. Mr. Potter has had extensive experience in the trial of cases in the Commonwealth of Massachusetts for plaintiffs and defendants. He has tried cases in the Federal District Court, the Superior Court and District Courts in the Commonwealth, the Land Court and the Probate Court. The trials have included bench and jury trials. Mr. Potter also has had extensive experience in administrative law with many appearances before the Department of Public Utilities particularly as it relates to pipeline and siting issues in the natural gas industry.
Mr. Potter is co-editor and author of "A Practical Guide to Introducing Evidence: Basic Foundations and Objections," a publication considered by many to be one of the best trial practice publications in the Commonwealth of Massachusetts. Mr. Potter has taught numerous trial practice seminars and courses, including programs for the Advocacy Trial Institute and Massachusetts Continuing Legal Education, Inc. (MCLE) and has written several articles in conjunction with those programs. From 1987-91, he was a lecturer and faculty member at the MCLE-NELI Trial Advocacy Institute. From 1988-96, he was chairperson of the MCLE program “Fundamentals of Civil Trial Advocacy.” In 2005, he was a faculty member on MCLE's Deposition Practice Seminar and in 2006 he was co-chair of MCLE's Hearsay Seminar. He also has lectured at the annual meeting of the National Association of College and University Attorneys.
He served in the U.S. Army from 1966-69. He is a graduate of Airborne School at Fort Benning, Ga. and Special Warfare School at Fort Bragg, N.C. Mr. Potter served as an officer with the U.S. Army Special Forces 46th Special Forces Company in Lopburi, Thailand and later as company commander with the 10th Special Forces Group at Fort Devens, Mass.
