Linda Auerbach Allderdice is a litigation partner in the firm's Los Angeles office and heads the firm's Labor, Employment and Benefits Practice Group in California. Ms. Allderdice represents clients in complex litigation in all aspects of labor and employment law including class action litigation, advises clients on compliance with state and federal labor and employment laws, and represents companies in matters involving labor relations for management, including union avoidance, collective bargaining and unfair labor practice proceedings before the National Labor Relations Board.

Ms. Allderdice has worked with clients in a wide range of industries, including transportation, hospitality, real estate, manufacturing, electronics and technology, entertainment, healthcare and retail. Regularly appearing in state and federal courts and before administrative agencies and arbitration tribunals, Ms. Allderdice litigates a broad spectrum of employment-related disputes, including discrimination, harassment, and wrongful termination claims; wage and hour individual as well as collective or class action claims; unfair competition, trade secrets and defecting employee claims; defamation and privacy issues; and intellectual property disputes. Ms. Allderdice regularly participates in alternative dispute resolution, including mediations and arbitrations of employment-related disputes. Ms. Allderdice counsels employers on compliance with state and federal employment-related regulatory statutes, including among others Title VII, NLRA, ADA, ADEA, FLSA and FMLA.

Employment Law Experience

Ms. Allderdice counsels and provides advice on a wide range of employment-related matters, including compliance with state and federal regulatory statutes, employment law issues arising from mergers and acquisitions including the sale and acquisition of hotel and resort properties, and corporate organization, restructuring and communications.

Ms. Allderdice has substantial experience in representing companies in proceedings before administrative agencies including the California Department of Fair Employment and Housing, the California Labor Commissioner, the EEOC, the U.S. Department of Labor, the OFCCP, and criminal investigations related to the workplace. As part of her litigation practice, Ms. Allderdice regularly defends companies in state and federal court or in arbitration forums, in employment law matters involving claims of discrimination, harassment, wrongful termination, breach of contract, privacy, defamation, trade secret, and unfair competition claims. Defending class action or collective claims under wage and hour laws is a special focus of Ms. Allderdice's litigation practice. In state and federal court, Ms. Allderdice has defended companies involving classification, vacation pay, meal and rest period, and overtime claims. A significant part of Ms. Allderdice's litigation practice involves alternative dispute resolution, including mediation and negotiation of pre-litigation settlements.

Labor Relations for Management

Ms. Allderdice began her legal career at the National Labor Relations Board in Washington, D.C. In private practice, Ms. Allderdice has extensive experience in matters involving labor relations for management, representing companies including hotel and resort properties in collective bargaining, labor contract interpretation and administration, investigations, arbitrations, and representation and unfair labor practice proceedings before the NLRB.

Firm Leadership Roles

Ms. Allderdice heads the Public and Charitable Service Department for the Los Angeles Office. She is a member of the firm's Diversity Council and is Chair of the Los Angeles Office Diversity Committee.

Ms. Allderdice was an adjunct professor at UCLA School of Law in Spring 2011.
