Robert L. Rhodes, Jr. is a member of the firm wide environmental practice. He has experience at the federal, state and local level in environmental and water resources matters including mining and construction activities in water and wetlands, industrial facility and residential development, and surface and ground water quality and quantity regulatory matters. The focus of his practice is assisting clients obtain necessary development permits and other governmental approvals for major projects. He has assisted mining interests and residential developers in obtaining Section 404 Clean Water Act permits and in complying with associated environmental review requirements under the National Environmental Policy Act (NEPA). His experience also includes, Superfund counsel to numerous clients facing liabilities at sites located throughout the United States; counsel to companies engaged in both prosecution and defense of private cost recovery actions under Superfund and state statutory and common law remedies; counsel for federal and state permitting of solid waste disposal facilities and industrial wastewater discharges being responsible for all the construction approvals and NEPA issues; counsel in defense of enforcement actions and citizen suit actions under Clean Air Act, Clean Water Act (NPDES permits), the Resource Conservation & Recovery Act, and comparable state environmental laws. He has also served as environmental due diligence counsel for clients seeking to acquire industrial manufacturing facilities and for lending institutions considering the financing of such acquisitions.
