Respond Quickly to New Marketplace Notice

Employers have begun receiving notices from the government's health insurance marketplaces as mandated by the Affordable Care Act (ACA) and it is advised that a quick response from the employers may limit employer-mandate liability.

However, attorney Nicole Elliott noted that there has been some confusion from employers as to the purpose of these notices, hindering a fast response. On the ACA's requirement that marketplaces send notices to employers if an employee receives an advance payment of a premium tax credit, Ms. Elliott said that "it is an important notice for employers to watch for because it indicates they might be liable for the employer shared responsibility payment, a tax imposed by the IRS."
